LIFE IMPRISONMENT TO SEVEN ACCUSED INCLUDING FORMER MP IN A CASE RELATED TO MURDER OF SHRI AMIT JETHWA, AN RTI ACTIVIST

The Special Judge, CBI, City Session’s Court, Bhadra, Ahmedabad(Gujarat) has today sentenced S/Shri Dinubhai Boghabhai Solanki, former MP; Bahadursinh Dhiruba Vadher, then Police Constable;

Pachanbhai @ Shivabhai Desai; Sanjay Parbatbhai Chouhan; Pratapbhai @ Shivabhai; Udaji and Shailesh Nanalal Pandya, all to undergo Life Imprisonment and fines ranging from Rs.25,000/- to Rs.15 Lakh in a CBI case related to murder of Shri Amit Jethwa, an RTI Activist.

CBI had registered the case on 06.10.2012 on the orders of the Gujarat High Court and taken over the investigation of FIR No.163/2010, earlier registered U/s 302, 114 of IPC and Section 25(1)(b)(a) of Arms Act, 1959 at Police Station Sola, Ahmedabad on the allegations that Shri Amit Jethwa, Environmentalist and RTI Activist was shot dead on 20.07.2010 at Satyamev Complex, Ahmedabad. The father of the deceased was not satisfied with the investigation of the police and he approached High Court of Gujarat alleging that the role of Shri Dinubhai Boghabhai Solanki, MP, Junagarh was not looked into by the police. Accordingly, the High Court of Gujarat vide its order dated 25.09.2012 transferred the case for further investigation to CBI.

During further investigation, ample evidence had come on record that Shri Amit Jethwa was collecting information about the illegal activities of Shri Dinubhai Boghabhai Solanki, and filed a PIL in the Gujarat High Court on 28.06.2010. In this PIL, Shri Dinubhai Boghabhai Solanki and his nephew Pratapbhai @ Shivabhai Solanki were impleaded as respondents on 06.07.2010. It was also established that Shri Dinubhai Boghabhai Solanki hatched a conspiracy with other co-accused persons to eliminate Amit Jethwa.

After thorough investigation, a chargesheet was filed against the accused persons in the Court of ACJM(Special Cases), Mirzapur, Ahmedabad on 21.12.2013.

The Trial Court found the accused guilty and convicted them.
