FIVE YEARS IMPRISONMENT WITH FINE OF Rs. TWENTY LAKH TO THEN COMMISSIONER OF CUSTOMS & CENTRAL EXCISE IN A DISPROPORTIONATE ASSETS CASE

The Special Judge, Rouse Avenue Court Complex, New Delhi has sentenced Sh. VK Puri, then Commissioner of Customs and Central Excise, Lucknow and his wife Smt. Amita Puri, both to undergo five years Simple Imprisonment with fine of Rs. 20 lakh each in disproportionate assets case.

CBI had registered a case on 20.02.2002 u/s 13(2) r/w Section 13 (1) (e) of PC Act, 1988 against Sh. Vijay Kumar Puri, then Commissioner of Customs & Central Excise, Lucknow (an officer of Indian Customs and Central Excise Services, 1976 batch) on the allegations that the accused while working in different capacities during the period from 01.06.1988 to 22.02.2002 came into possession of assets which were disproportionate to his known sources of income by Rs. 1,30,70,863 (approx.). His wife Smt. Amita Puri allegedly abetted him in commission of the offence by executing several documents in various banks and other institutions. It was further alleged that Sh. VK Puri and Smt. Amita Puri conspired with Sh. Vinesh Vyas and fraudulently got prepared 86 false & fabricated bills of M/s Shree Ambika Jewellers, Indore showing purported sale of gold jewellery/silver utensils by Smt. Amita Puri to the said jeweler/firm. After investigation, a chargesheet u/s 120B, 193 of IPC and Section 13 (2) r/w 13 (1) (e) of PC Act, 1988 was filed on 30.01.2004 against the accused persons.

The Trial Court found the said accused persons guilty and convicted them. With regard to Sh. Vinesh Vyas, the Trial Court passed an order and filed a complaint u/s 195 of IPC against him and sent the file to the CMM/ACMM for further action.
